We exclusively operate on the basis of the 2017 German Freight Forwarders’ Standard Terms and Conditions (ADSp 2017) and – in so far as they are not applicable to the provision of logistics services – on the basis of the Logistics General Terms and Conditions (Logistik-AGB) in compliance with the ADR and CDR. Note: The ADSp 2017 differ from applicable law in clause 23 regarding the liability limit for cargo damages (Section 431 of the German Commercial Code HGB) by limiting the legal liability to 2 SDR/kg in case of multi-modal carriage including sea transport and in case the place where the damage occurred is unknown. Moreover, the standard liability of 8.33 SDR/kg is limited to EUR 1 million per claim and to EUR 2 million per event, as long as it corresponds to at least 2 SDR/kg.
